Building permits in 2025: Changes you need to know about

Are you planning to apply for a building permit in 2025? Introduced in 1943, this administrative authorization underwent several important changes on January 1, 2025. Cerfa forms update

As of January 1ᵉʳ 2025, new Cerfa forms are required for all town planning formalities. These forms incorporate recent regulatory developments, in particular the possibility of requesting a modifying or regularizing prior declaration, as well as a transfer of a prior declaration. For example, Cerfa form n°13409*15 is now used for building permit applications other than those for a detached house or its annexes.

Introduction of development permits by tranche

A significant new feature introduced in 2025 is the possibility of using development permits in phases. This regulatory change, introduced by Decree no. 2024-1043 of November 18, 2024, enables developers to build and market a real estate project in successive phases, offering greater flexibility to developers and investors.

In concrete terms, when applying for a planning permission, the application must include a plan detailing the different phases of work envisaged, as well as a guarantee certificate for the first phase. Once work on a tranche has been completed and declared compliant via the Declaration of Completion and Conformity of Work (DAACT), the developer can provide the completion guarantee for the next tranche, thereby authorizing its marketing.

Reinforcement of the 2020 Environmental Regulations (RE2020)

The RE2020, which came into force in 2020, was reinforced on January 1ᵉʳ 2025 with stricter carbon emission thresholds for new builds. These new requirements aim to reduce the carbon footprint of buildings and improve their energy efficiency. For example, multi-family housing must now comply with more demanding carbon impact indices, with a reduction of almost 50% on previous standards. These changes include an end to the exclusive use of gas-fired solutions for heating.

Development tax adjustment

Local tax, the development tax applies to constructions, reconstructions and extensions as soon as the operation is subject to administrative authorization (building permit or prior request). It is collected for the benefit of the region, the department and the municipality. It is calculated according to the formula :

Taxable area of building x Flat-rate value x Rate.

  • Taxable floor area: sum of enclosed and covered floor areas with a ceiling height of 1.80 m or more (excluding stair and elevator spaces), provided that the area exceeds 5 m².
  • Flat-rate value: €930/m² outside Île-de-France, €1,029/m² in Île-de-France ;
  • The rate: it is determined by the local authorities.
